Fresh assessment to be made of illegal construction at Ganga flood plain in Pauri
A three-member bench of Justices Adarsh Kumar Goel, SP Wangdi and K Ramakrishnan of the National Green Tribunal (NGT) on May 17, 2019 directed a fresh assessment of illegal construction on the flood plain of the Ganga in Uttarakhand's Pauri district. It also called for an action-taken report to be submitted in the matter within two months.
The tribunal agreed with the view of the State Pollution Control Board that compensation should be determined not only on the basis of royalty but should also take into account components like cost of restoration, cost of services forgone forever and cost of the mined material.
Committee to be constituted for compliance of EC for Iskcon temple at Vrindavan
On May 17, 2019, the NGT heard an application filed by Manikesh Chaturvedi on the compliance of conditions in the Environmental Clearance granted to the International Society of Krishna Consciousness (Iskcon) for constructing the Sri Vrindavan Chandra Mandir at Vrindavan, Mathura, Uttar Pradesh.
The Report submitted by the Central Pollution Control Board (CPCB) pointed to deficiencies in rain water harvesting, operation of diesel generator sets, compliance of the Construction and Demolition Waste Management Rules 2016 and the extraction of ground water.
The tribunal, finding the report submitted by the CPCB and the Union Ministry of Environment and Forests, incomplete, directed for the constitution of a joint Committee comprising representatives of the ministry, CPCB and Central Groundwater Authority. The CPCB would be the nodal agency for compliance and coordination of the committee and submission of a report within one month.
DDA to submit report on waste dumping in Neela Hauz lake
On May 17, 2019, the NGT, in its order on waste dumping in Delhi's Neela Hauz lake, said that the conservation of a water body was essential for the environment as it helped recharging ground water and maintaining micro-climate in the area. The Delhi Development Authority has been asked to submit an action-taken report.
Report sought on illegally operating polluting units in Mathura
On May 17, 2019, the NGT called for a detailed report to be submitted with regard to the illegal operation of polluting units at Mathura city as well as Jai Singh Pura / Guar Kendra within three months. The tribunal made this order after being informed by the Uttar Pradesh State Pollution Control Board that some units were operating illegally after taking fresh electricity connection and operating in night.
