The division bench comprising Chief Justice S N Variava and Justice S K Mahajan have asked the respondents to file replies by August 4. The Health ministry had failed to use Rs 84.50 crore during 1995-96. This rose to Rs 121.96 crore during 1996-97 and Rs 148.90 crore during 1997-98, the petition said. It added that the under-utilisation of funds had affected the health services in the country.
